The Law of People's Republic of China on Wholly Foreign-owned Enterprises

One of the most important amendments made to the WFOE law is the release of the export requirement. In the past, WFOEs were required to export at least 50% of its products. With the amendment of the WFOE Law and its detailed rules, such requirement is deleted. The principal change is made to article 3 of the WFOE law, which deletes the wording that a WFOE must export all or most of its products. New wording is adopted that China ENCOURAGES (rather than request) WFOE to export its products. The articles 3, 9, 43, 46 of the detailed rules are revised accordingly to match the revision of the WFOE Law on this respect.
