New Maritime Law Sharpens Focus of Maritime Procedures


The "Marine Action Special Procedure Law of the People's Republic of China" was published in "State Council of the People's Republic of China Gazette" and will go into effect after July 1, 2000. This is a special civil procedure law in accordance with of the "Civil Procedure Law of the People's Republic of China".

This law includes twelve chapters addressing 127 items. Areas of maritime law and practice covered will include: details regarding the security of maritime claims, new stipulations with respect to vessel arrests and the sale of cargoes, vessels, and fuel and materials aboard vessels, marine injunctions and evidence, marine securities, vessel collisions and general averages, marine insurance and rights of subrogation, proceedings for supervising and prompting the clearance of debt, limitation funds for maritime liability claims, creditor registrations and payments, and a host of other areas of maritime law.
